Who coined the phrase "legislating from the bench"?

Hi everyone - I'm hoping someone can answer my question. I'm in the middle of a discussion with a person who is throwing that phrase around, and saying it's been in the vernacular forever. I say no. (I must be right, I am sure!)
Anyhow, I figured if anyone could help me answer that questions, it would be the Kossaks. I've been googling, and while I've found a lot of good articles, I cannot find the answer to my question.
